These Terms of Service ("Terms") govern your purchase, use, and operation of any products ("Products") sold by Science Driven Performance ("SDP," "we," "us," "our"), including but not limited to measurement devices, safety equipment, apparel, and accessories. By purchasing or using any SDP Product, you ("Customer," "you") agree to be bound by these Terms.

1. Intended Use

1.1 SDP Products are designed and manufactured for motorsport and off-track use only (e.g., pit areas, workshops, garages, testing facilities, and racing events).

1.2 Unless explicitly stated otherwise in writing, our Products are not certified for legal-for-trade, medical, life-support, or commercial weighing/trading applications.

1.3 You agree to use each Product only as described in its accompanying documentation and for its stated intended purpose.

2. Acknowledgment of Motorsport Risks

2.1 You acknowledge that motorsport, vehicle setup, and related activities involve inherent risks, including but not limited to:

Damage to vehicles, equipment, or property

Serious personal injury or death

Performance variability based on setup decisions, environmental factors, or user error

2.2 You voluntarily assume full responsibility for all risks associated with using SDP Products, including any decisions, adjustments, or racing actions taken based on Product output.

2.3 SDP is not liable for:

Race results or performance outcomes

Vehicle or equipment damage resulting from setup decisions

Injuries occurring during Product use, vehicle preparation, or on-track activities

3. Product Specifications & Performance

3.1 While we strive for accuracy and quality, SDP does not guarantee that any Product will be free from minor manufacturing variations, cosmetic imperfections, or performance deviations caused by:

Improper installation, handling, or storage

Environmental conditions (temperature, humidity, dust, vibration)

Physical damage or user error

Normal wear and tear over time

3.2 Measurements or performance data provided by any SDP Product are for reference purposes only and should be verified by the user when safety or regulatory compliance is required.

4. Limited Warranty

4.1 Warranty Period: SDP warrants that Products will be free from material defects in materials and workmanship for a period of one (1) year from the original purchase date.

4.2 What We Will Do: During the warranty period, SDP will, at its option and as your exclusive remedy:

Repair the defective Product

Replace it with a new or refurbished unit

Refund the purchase price upon return

4.3 What Is NOT Covered (Exclusions): This warranty does not cover damage or failure resulting from:

Misuse, abuse, improper handling, or impact damage

Exposure to moisture, liquids, chemicals, extreme temperatures, or dust beyond stated limits

Unauthorized repairs, modifications, or opening of the Product

Incorrect installation or use of incompatible accessories

Normal wear and tear (e.g., fabric fading on race suits, grip wear on gloves)

Damage during shipping (file claim with carrier)

Use contrary to provided documentation

4.4 Warranty Claim Process:

Provide proof of purchase and description of the issue

Return the Product at your cost (we cover return shipping if defect is confirmed)

4.5 DISCLAIMER OF OTHER WARRANTIES: TO THE MAXIMUM EXTENT PERMITTED BY LAW, SDP DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

5. Limitation of Liability

5.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, SDP SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages

Loss of profits, data, racing opportunities, or championship standings

Property damage, personal injury, or death arising from Product use

5.2 Total Liability Cap: SDP's total cumulative liability arising from or related to these Terms or any Product shall not exceed the amount you paid for that specific Product.

5.3 This limitation applies regardless of the legal theory (contract, warranty, tort, negligence, strict liability, or otherwise).

6. Returns & Refunds

6.1 Return Period: You may return a Product within 30 days of delivery for a full refund, provided it is in original condition with all accessories and packaging.

6.2 Return Process: Contact us for a Return Authorization before shipping. Unauthorized returns may be refused.

6.3 Return Shipping: You are responsible for return shipping costs unless the return results from our error.

6.4 Refunds: Refunds will be issued to the original payment method within 14 days of receiving and inspecting the returned Product.

7. Safety & Compliance for Safety Equipment (Race suits, gloves, helmets, etc.)

7.1 If you purchase safety equipment (e.g., race suits, gloves, helmets, harnesses), you acknowledge that:

No safety equipment can guarantee protection against injury or death

Such equipment must be inspected before each use and replaced after any significant impact or visible damage

You are responsible for ensuring the equipment meets the specific safety regulations of your racing series (e.g., FIA, SFI, CIK, local track rules)

7.2 SDP is not responsible for a racing organization's rejection of any Product due to certification changes, rule updates, or expired homologation.

8. Intellectual Property

8.1 All intellectual property rights in SDP Products—including hardware design, firmware, software, documentation, trademarks, and branding—remain the exclusive property of SDP.

8.2 You may not:

Reverse engineer, disassemble, or decompress any Product firmware or software

Copy, modify, or create derivative works

Remove any copyright or trademark notices

9. Compliance with Laws & Racing Regulations

9.1 You are solely responsible for complying with all applicable laws, regulations, and track/racing series rules regarding the use of SDP Products in your jurisdiction and at any racing facility.

9.2 SDP makes no representation that any Product complies with specific racing series regulations (e.g., FIA, NASA, SCCA, CIK, WKA). Verification is your responsibility.

10. Indemnification

You agree to indemnify, defend, and hold harmless SDP, its owners, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

Your misuse of any Product

Your violation of these Terms

Your violation of any applicable laws or racing regulations

Any injury or damage occurring during Product use

11. Modifications to Terms

SDP reserves the right to update these Terms at any time. Changes will be posted on our website. Your continued use of any Product after such changes constitutes acceptance.

12. Governing Law & Dispute Resolution

12.1 These Terms shall be governed by the laws of [Your State/Country] , without regard to conflict of law principles.
